Delhi High Court Dismisses Congress’s Pleas Against Tax Reassessment Proceedings

The Delhi High Court on Friday rejected the Congress party’s petitions challenging the reassessment proceedings initiated by the Income Tax Department.

A bench of Justices Yashwant Varma and Purushaindra Kumar Kaurav announced the decision, stating, “We dismiss the writ petitions. A detailed order will be provided later.”

On March 20, the high court had reserved its decision on the party’s pleas against the tax reassessment proceedings for the years 2014-15, 2015-16, and 2016-17.

The Congress party argued that the reassessment proceedings were time-barred.

Senior advocate Abhishek Singhvi, representing the Congress party, claimed that the tax reassessment proceedings exceeded the time limit, as the Income Tax Department could only go back a maximum of six assessment years.

However, the Income Tax Department argued that there was no violation of statutory provisions and that the party had undisclosed income of over 520 crore rupees.

Previously, the high court had declined to intervene in the Income Tax Appellate Tribunal’s decision not to stay a notice issued to the Congress for the recovery of over 100 crore rupees in outstanding taxes.

The assessing officer had raised a tax demand of over 100 crore rupees for the assessment year 2018-19, based on an assessed income of over 199 crore rupees.
