Allahabad High Court Strikes Down UP Madarsa Education Act as “Unconstitutional”

The Allahabad High Court has ruled that the UP Board of Madarsa Education Act, 2004 is unconstitutional because it goes against the principle of secularism.

A division bench consisting of Justices Vivek Chaudhary and Subhash Vidyarthi has instructed the state government to integrate madrasa students into the formal education system.

This decision was made in response to a petition filed by Anshuman Singh Rathore, who contested the management of the UP Madrasa board by the minority welfare department.

A detailed judgment on this case is still pending.

This ruling follows the UP government’s recent initiative to survey Islamic educational institutions in the state and the formation of a Special Investigating Team (SIT) in October to investigate foreign funding received by madrasas.
