Calcutta High Court Rebukes State Police Over FIR Against NIA Officer

After a National Investigation Agency (NIA) team faced strong opposition during a raid in West Bengal, the Calcutta High Court today reprimanded the state police for filing a First Information Report (FIR) against an officer from the central probe agency.

The NIA team was in Bhupatinagar in Bengal’s Purba Medinipur district on Saturday conducting a raid related to a 2022 blast that resulted in three deaths. During the raid, they encountered resistance from local residents.

Following the confrontation, a woman lodged a complaint with the state police, accusing the NIA team of forcibly entering her home, assaulting her husband, and verbally abusing her. The police registered an FIR based on her complaint, including charges related to causing serious harm and using criminal force against a woman.

The high court stated that the NIA officials were acting within the law during the raid and were not required to seek permission from the state police. The court also questioned the basis for the FIR filed by the state police, as the medical report only mentioned minor injuries and did not indicate serious harm.

The court scheduled a hearing for April 29 and instructed the state police not to arrest the accused NIA officers or file any final reports until then. The accused officers can be questioned via video conference with a 72-hour notice, and the interrogation must be recorded.

Prior to this, Bengal police had summoned two NIA officers as witnesses in the case and requested one injured officer to provide his medical records and the allegedly attacked car for forensic examination.
