New Year Gift for Dyshant Chautala: Powers of Tehesildars and Naib-Tehesildars for registration of property to be curtailed EO, HSVP will be empowered for registration of properties falling under jurisdiction of HSVP.

Haryana Government is considering a proposal which will curtail the powers of Tehesildars and Naib-Tehesildars for registration of property.

According to the new proposal which is being examined from legal point of view , registration of property falling under the jurisdiction of Haryana Shahari Vikas Pradhikaran will be done by the concerned Estate Officer of the HSVP, instead of Tehesildar and Naib-Tehesildars.

Besides the Sub-Divisional-Magistrates will also be empowered for registration of property ,the powers which at present are enjoyed by the Tehesildar and Naib-Tehesildars. It is interesting to mention here that during

last Haryana Day, CM Manohar Lal while interacting with the Deputy Commissioners of the State via video-conference has proudly announced to streamline the process of registration of property adding that now besides Tehesildars and Naib-Tehesildars, powers of registration of property will also be given to the SDM,s and City Magistrates. At that time powerful lobby of Tehesildars and Naib-Tehesildars has sabotaged the move of CM Manohar Lal.

That matter is being examined from a legal point of view .Under the new proposal, City Magistrates will not be given powers for registration of property.
The move is seen in political and administrative circles as a calculated move to curtail powers of DCM, Dyushant Chautala.
CM Manohar Lal has received inputs from various official and unofficial sources about rampant corruption prevailing while registering the property.

It is yet to be seen how Dyushant Chautala will react to the new proposal? Lobby of Tehsildar and Naib-Tehesildars is very powerful which can be judged from the fact that CM Manohar Lal was forced to drop action against those Tehesildars, Naib-Tehesildars and Revenue officers who were found accused of doing registration of property during the Corona period when there was complete lockdown in the State.

EPILOGUE

Unsolicited advice to A.G. Baldev Mahajan. Some suggestions for above proposal so that issue may not be dragged in courts.

Although Mahajan is very competent and capable of converting pigeon into peacock and am small fry as far as legal issues are concerned.

My suggestions in public interest.

Currently SDO(C) serves as Collector for adjudication of cases of undervalued registered deeds under section 47 A of Indian Stamp Act,1899.

If they are given powers of deed registration then Legal situation will be complicated as no one can be a judge of his own acts.In the amended Act this should be made clear.

It should also be made clear that who will serve for adjudication of cases of undervalued stamp duty in registration done by E.O of HSVP.

A.G is drawing hefty salary from the Govt. but I have given above suggestions in public interest free of cost.
