PM CARES Not a Fund of Government of India, PMO tells Delhi HC

New Delhi, 23rd Sep. The Prime Minister’s Office (PMO) has filed a reply in the Delhi High Court to clarify the dispute related to the PM Cares Fund which was created to deal with the Corona crisis.

PMO informed Delhi High Court that irrespective of whether PM CARES is “State” or “Public Authority”, it is not permissible to disclose third-party information.

PMO told Delhi HC that to ensure the transparency, the audited report is put on the official website of the Trust along with the details of utilization of funds received by the Trust.

The Prime Minister’s Office informed Delhi High Court that PM CARES Fund is a “trust” whose funds are audited by an auditor who is a chartered accountant drawn from the panel prepared by the Controller and Auditor General of India

This petition was filed by Samyak Gangwal. In this, a request has been made to direct the PM Cares Fund to be declared a state under the Constitution, so that transparency can be ensured in its functioning. In response to this petition, this affidavit was filed by the government.

In PMO’s affidavit, it has been said that irrespective of whether PM CARES is “State” or “Public Authority”, it is not permissible to disclose third-party information.

A bench of Chief Justice DN Patel and Justice Amit Bansal fixed September 27 for further hearing of the matter
