Supreme Court Refuses to Stop Gyanvapi Mosque Survey

New Delhi, 13th May. The Supreme Court declined to stop the Gyanvapi Mosque survey on Friday. This comes after the Anjuman Intezamia Masajid Committee approached the Supreme Court seeking command to put a stay on the survey of the Gyanvapi Mosque premises, which is next to the famous Kashi Vishwanath Temple in Varanasi.

Senior advocate Huzefa Ahmadi explained the matter before a bench headed by Chief Justice of India (CJI) NV Ramana urging to order status quo in the case pending before the Varanasi civil court.

The bench, however, declined to grant status quo in the case stating that it was not aware of what the issue was, as it had not seen the papers.

“We have not seen the papers. We don’t even know what is the matter. I don’t know anything… how can I pass an order. I will read and then pass orders… let me see,” said CJI Ramana.

Ahmadi appearing for the Anjuman Intezamia Masajid Committee that oversees the Gyanvapi mosque sought an order of the status quo saying, “Survey has been directed in relation to Varanasi property. This is covered by the Places of Worship Act. Now the Court has ordered the Commissioner to conduct a survey.”

The Varanasi civil court had ordered a survey to inspect, conduct videography and collect evidence regarding the alleged existence of Hindu gods inside the Gyanvapi mosque located next to the Kashi Vishwanath Temple.

Earlier on Thursday, a Varanasi session court while hearing the case said that the survey inside the Gyanvapi mosque located next to the Kashi Vishwanath temple will continue and the report needs to be submitted by May 17. The session court also added two assistant advocates to the survey commission.

The Varanasi session court refused the plea to remove Court commissioner Ajay Mishra and added that the video inspection of the Gyanvapi mosque will continue and should be completed by Tuesday (May 17).
