New Delhi, 13th Oct: The Supreme Court on Tuesday deferred until Thursday the hearing on petitions concerning protests against Chief Election Commissioner Gyanesh Kumar on October 10, the closure of metro stations and disruptions in train services, after Justice V Mohana attended proceedings despite being unwell.
A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana was scheduled to hear several petitions related to the protests and alleged disruption of public transport services.
At the outset, the CJI informed lawyers that Justice Mohana was unwell but had nevertheless joined the proceedings. Solicitor General Tushar Mehta urged the bench to adjourn the hearing, stressing that health concerns should not be overlooked. Senior advocate Gopal Sankaranarayanan and other lawyers also agreed to the deferment.
Mehta further informed the court that the Centre’s deadline to respond to a plea alleging contempt of court over the continued operation of metro and train services ahead of the October 10 protest was due to expire on Tuesday. He said the affidavit was ready but sought additional time to make it more comprehensive.
The bench granted the Centre more time to file its response and directed that a copy of the affidavit be provided to the lawyers representing the petitioners. The matter will now be taken up on Thursday.
